Lusaka High Court Made A Disparate Announcement On Portland Cement Zambia

Lusaka High Court is a noted high court within the Zambian nation. The high court recently gave a final judgment on one of its longest pending cases of PortlandCement Zambia. The ownership of the cement factory has been contested by two different parties. One of them is Dr. Rajan Mahtani, a noted businessman, philanthropist and charity worker with more than 30 years of business experience in Zambia. His popularity among the masses as well as among industry counterparts can be attributed to his successful business ventures as well as his humble, transparent and ethical business practices. Dr. Mahtani is the founder and leader of some of the top companies in Zambia, including Finance Bank Zambia, Mahtani Group of Companies and Finsbury Investments. He is also an avid charity worker and has contributed to numerous NGOs and environmental groups. Dr. Mahtani registered the case of Portland Cement Zambia at the Lusaka High Court after the factory was illegally taken with the help of goons. While Dr. Mahtani has always stayed in the path of ethics and righteousness, it is the government and its law & order which has failed to provide right justice to him.
During the long stretched trial of 10 plus years, Dr. Rajan Mahtani has submitted numerous evidences and documents to support his claim. These included signed shareholder agreements, financial exhibits as well as independent audit reports. Despite these strong evidences, the final judgment was given against Dr. Mahtani’s claims. While it was definitely a shocking event, it was clear that the judgement was misdirected. As such, Dr. Mahtani now took the right step and launched an appeal to the higher court of appeal against this misdirected judgment.

It is a true fact that honest people are the major sufferers. They choose the path of honesty to shield themselves from future problems and gain respect from around but face various threats and roadblocks from those who are corrupt and engage in illegal activities. A similar fate has been holding Dr. Rajan Mahtani for a long time in the Zambian nation. Dr. Mahtani is a noted figure in Zambia. There is no doubt that he is one of the most successful yet grounded industrialists in Zambia, loved and admired by all. His companies have reached heights in terms of business achievement as well as a contribution towards the underprivileged sections of the society. Yet, he is constantly targeted by various groups and individuals and branded as the dishonest or shady businessman, without any proof or evidence. While these accusations and negative campaigns are short lives, they do create an atmosphere of negatively and suspicious. This has also resulted in the loss of businesses and future growth opportunities for many of Dr. Mahtani’s institutions. It is time to stop these completely now.

A deeper look at the Zambezi Portland Cement which is ongoing at the Lusaka High Court will clearly indicate the sorry state of the Zambian law and order. In spite of sharing all sorts of documents and evidence, the court has not been able to come up with a final judgment. In the meantime, the Zambezi Portland Cement, taken over by the Ventriglias, is turning into ruins. It is high time for the court to announce final judgment so that the factory can be revived under Dr. Mahtani and businesses can go as usual.

Money Laundering Scheme Busted In Zambia, Top Officials Involved

The Zambian nation went to a whole bewilderment when its national intelligence center, FIC (Financial Intelligence Center) revealed a mass money laundering bust. More unfortunate, the summary of individuals drew in with this illegal racket fuses the names of some top legal lawyers & counsels from Zambia. Moreover, it also contains the name of the official lawyer of the Ventriglias, Sakwiba Sikota.
While illegal activities and exercises are ordinary for this nation, the once-over reveals the level of criminal exercises by top specialists working in respected positions. These counselors are not only working in top government and private organization but are also associated with various top-ranking government officials and even some ministers. As per the list revealed by FIC, OMM Banda is at the top of people suspected of mass money laundering. He is a counselor working for the noted law firm Avik International. He has been rebuked for wasting money to Edgar Lungu, a renowned Zambian dictator. Meanwhile, Edgar has been ensuring himself by compelling that the trade out his record is for various government contracts. Since the trade included is out millions, the investigation has begun.

Apart from the above, the name of Sakwiba Sikota also popped out from the list. His company, Central Chambers, has been suspected of money laundering. Those who have worked closely for Dr. Mahtani are aware of Sikota’s unlawful involvement with the Ventriglias in establishing false cases against Dr. Mahtani. As such, his name in the list is not surprising. However, it is time for the Zambian Government to pull up its socks and start cleaning the nation of repeat criminals and offenders.

New Update Received On Case Between The Ventriglias And Dr. Mahtani

As per the latest update on the case between Dr. Rajan Mahtani and the Ventriglias, the judge has announced that the case hearing is closed. This is hailed as a milestone for the case which has been pending for the past nine years. The case was registered by Dr. Mahtani after the Zambezi Portland Cement was forcefully taken over by the Ventriglias. Dr. Mahtani is the owner of the Mahtani Group of Industries and Finsbury Investments, the latter being registered in the case. He also owned the Zambezi Portland.
The Ventriglias have counterclaimed that the shares held by Dr. Mahtani are not paid for. At the same time, Finsbury Investments has claimed shareholding of 58 percent which has been further substantiated by various evidence such as signed shareholder agreement and financial exhibits. Furthermore, Finsbury Investment also claimed that the total capital shares for the factory were paid entirely by Finsbury and the Ventriglias did not invest an even single cent in the share capital. During his ownership at the factory, Dr. Rajan Mahtani conducted audits by independent auditors. As per this independent report, Zambezi Portland Cement was established under joint venture partnership and Dr. Mahtani is registered as the sole joint venture partner. All these facts clearly indicate that with majority shares and joint venture partnership, Dr. Rajan Mahtani is the actual owner of the Zambezi Portland.

As per the judge handling this case, the final judgment will be announced post evaluation of the written and oral submissions. Both parties have been given time till December 2017 to share their submissions.

Lusaka High Court Judge Made New Announcement, Considers Milestone

The long-pending case between Dr. Rajan Mahtani owned Finsbury Investments and Ventriglias owned Ital Terrazzo Limited is nearing an end. The case has been going on for the past 9 years and the judge handling this case at present has hailed the proceedings as a milestone. The judge concluded the case. However, final judgment date is still pending and there are few processes left.
The case is for shareholding dispute and ownership of Zambezi Portland Cement for which both parties have claimed ownership. The cement factory was under the ownership of Dr. Rajan Mahtani. However, it was illegally and forcefully taken over by the Ventriglias. Since then, Dr. Mahtani has been fighting the case. The Ventriglias then launched a counterclaim in which they have contended that the shares of Dr. Mahtani are not paid for. However, the legal statements and shareholder agreements have been proved otherwise.
Over the course of the case proceedings, various exhibits and shareholder agreements have been submitted by Finsbury Investments proving his claim over the factory. For instance, the official signed shareholder agreement for the ZPC clearly indicates that Finsbury Investments hold 58 percent shares and the Ventriglias family owned Ital Terrazzo holds only 42 percent. Furthermore, an independent audit report clearly proves that Zambezi Portland was run as a joint venture wherein Dr. Mahtani was a joint venture partner with majority shares. Rest of the shares were distributed among the Ventriglias family members and other shareholders. Statements and exhibits were submitted by Finsbury Investments proving their investments in share capital as well as in the factory, which is more than USD 8 million.

All of the above evidences clearly indicate that Dr. Rajan Mahtani is the legal owner of the factory. The rest is in the hands of the judge and the court.

Simaata’s Failed Attempt Against Finance Bank Is A Warning For Conspirators

If one gives a deeper view to the activities of the conspirators in the past years, a pattern seems to emerge. Previously, majority of these conspirators worked by themselves at regular intervals to defame their targets. However, recent activities confirm that these conspirators have joined hands with each other and now trying to establish coordinated attacks. Dr. Mahtani has been a major victim of these conspiracies over the years. He is a noted individual and popular businessman in Zambia and is responsible for various successful businesses. The common people are the major benefits of Dr. Mahtani’s establishments, adding to its popularity every day. This has obviously made the conspirators jealous and full of hate.

The recent incident between Finance Bank Zambia and Simaata is an example showing the level of conspiracy some people can undertake to fulfill their hatred or jealousy. Simaata recently accused Finance Bank of fraud and malpractice. These accusations were given as testimonials at several courts, which amplified the value of his fake rumors and started a negative campaign against the bank. Even after Finance Bank claimed that Simaata was breaching the contract he signed with the bank, the spotlight was majorly on the bank which was increasingly losing its customers and clientele. Finance Bank’s only viable option left was to take this matter to legal space and a case was launched at the Supreme Court of Zambia, with Dr. Mahtani’s help.

The case went on for months and was ultimately won by Finance Bank. With this win, the conspirators of the bank are also becoming more cautious with their fake news campaigns and have reduced spreading the ridiculous news.
